Medical malpractice case in the 41st Judicial District Court. Prior to the trial, Plaintiffs settled with Defendants Jose Lopez, M.D., Erica Sanchez, N.P. andThe Hospitals of Providence — Memorial Campus f/k/a Tenet Hospitals, Limited, A Texas Limited Partnership d/b/a Providence Memorial Hospital.  Following the conclusion of Plaintiffs’ evidence, the Court granted Defendants Oluwamayoma Familua, M.D. and Alejandro Ovalle, M.D.’sMotion for Judgment as a Matter of Law disposing of the case.

Medical malpractice case in the 384th Judicial District Court. The jury found that Defendant’s actions were not the proximate cause of  Plaintiff’s injuries and awarded no damages.

  • August 3, 2022. Edward Garcia, Individually, on Behalf of All Wrongful Death Beneficiaries, and as Personal Representative of the Estate of Lilia Garcia, Deceased v. Jose Ignacia Mendez-Martinez, M.D. and Cardiology Care Consultants, P.A.; Cause No. 2013DCV2153. Medical malpractice case in the 327th Judicial District Court. The jury found that Defendant’s actions were not the proximate cause of the death of Lilia Garcia and awarded no damages.
  • July 21, 2022. Loretta Salazar, Individually and on Behalf of the Estate of Ernest Salazar and on Behalf of all Wrongful Death Beneficiaries v. Hector A. Payan, M.D. and Ric A. Bradform, D.O.; Cause No. 2016DCV4437. Medical malpractice case in the 120th Judicial District Court. The jury found that Defendants’ actions were not the proximate cause of the death of Ernest Salazar and awarded no damages.

  • October 4, 2019. Jorge Jimenez v. Jeffrey Spier, M.D. and Rio Grande Urology, P.A. Cause No. 2016DCV2041. Medical malpractice case in the 171st Judicial District Court. The jury found that Defendants’ actions were not the proximate cause of Plaintiff’s injuries and awarded no damages
  • June 26, 2019. Ramon Castro, Jr. v. El Paso Colon & Rectal Clinic, P.A., Jaime R. Gomez, M.D., and Edgardo Aguila, CRNA; Cause No. 2013DCV1493.  Medical malpractice case in the County Court at Law # 6. The jury found that Defendants’ actions were not the proximate cause of Plaintiff’s injuries and awarded no damages. The Court awarded $5,023.43 in taxable Court costs to Defendants.
  • January 10, 2019. Earl Dunnington, III v. Ian Lyn, M.D.; Cause No. 2010-5045. Medical malpractice case in the County Court at Law # 3. The jury found in favor of Defendant and awarded no damages.

2018

  • September 26, 2018. Martha A. Rios as Next Friend and as Attorney-in-Fact of Angelo Rios v. Sunwest Behavorial Health, LLC as d/b/a of Atlantis Health Services, Jean R. Vanderpool, M.D., Boris Kaim, M.D., Boris Kaim, M.D., P.A., and Texas Neurodiagnostic Headache and Sleep Disorders Center, P.A.; Cause No. 2012DCV5307. Medical malpractice case in the County Court at Law # 5. At trial, the only remaining Defendants were Boris Kaim, M.D. and Boris Kaim, M.D., P.A. The jury found in favor of Defendants and awarded no damages to Plaintiff.
  • August 9, 2018. Erika Bickhart v. Mabel Martinez, N.P. and Physicians Healthcare Associates, P.A. n/k/a El Paso Med Partners, P.A.; Cause No. 2013DCV2392. Medical malpractice case in the 384th Judicial District Court. The jury determined that Plaintiff and a party previously designated as a responsible third party were each fifty percent (50%) responsible for Plaintiff’s injuries and the Court entered a take nothing judgment in favor of Defendants.
  • May 24, 2018. Sandra Bernal, Individually and as Independent Administrator of the Estate of Margarita G. Medrano, Deceased, Carolina Hernandez, Carlos M. Medrano, Maria Magdalena Alexus, Raul Medrano, and Maria V. Tellez v. Hector Flores, M.D.; Cause No. 2013DCV3968. Medical malpractice case in the 448th Judicial District Court. The jury determined that Defendant’s actions were not the proximate cause of death. The Court entered Judgment in favor of Defendant and awarded Defendant $4,791.59 in taxable court costs.

2017

  • March 30, 2017.  Aurora G. Valdez, Individually, and as Surviving Spouse and Heir of David Valdez, Deceased v. Lewis A. Leavitt, M.D. and Mohammed Al-Najar, M.D.; Cause No. 2011-2971.  Medical malpractice case in the 448th Judicial District Court.  The jury determined that the Defendants’ actions were not the proximate cause of the injuries/death of David Valdez and found in favor of Defendants.
  • January 30, 2017.  Charles Collins and Linda Collins v. Cesar Vivanco, M.D.; Cause No. 2014DCV2729.  Medical malpractice case in County Court at Law # 3.  The jury found in the actions of the Defendant were not the proximate cause of the injuries in the case.
  • January 30, 2017.  Helen Estrada, Individually, and on Behalf of All Wrongful Death Beneficiaries and as Representative of the Estate of Richard Estrada, Deceased v. James B. Gibson, M.D. and Ahmad M. Hajj, M.D.; Cause No. 2008-P00670A.  Medical malpractice case in Probate Court # 2.  The jury found in favor of Defendants and determined that Richard Estrada’s actions were the sole cause of his death.

2015

  • November 2, 2015.  Louie G. Alvarez v. Jose A. Alicea, M.D.; Cause No. 2012DCV03540.  Negligence/Medical Malpractice case in the 210th Judicial District Court.  The jury determined that the Defendant was not negligent and rendered a verdict for the Defendant.
